Conveyancing Services – what are they?
Conveyancing Services in the legal sense involve anything to do with the transfer of property (real estate) or land. The types of transaction which normally apply are:
- Purchases of property or land
- Sales of property or land
- Transfers of Equity
- Remortgages
Solicitors or property lawyers carrying out any of the above would be providing Conveyancing Services to their clients. If you are using a solicitor for conveyancing services then you need to ensure that they are members of the Law Society. If using a propety lawyer (licensed conveyancer) then they should be members of the Council for Licensed Conveyancers (CLC).
Whether you are selling or buying your property you will need conveyancing services and will need to find solicitors or property lawyers to deal with the conveyancing. Most of us have little or no contact with the law in our daily lives so the idea of having to find solicitors can seem daunting. When it comes to conveyancing, however, it is usually quite easy to find lawyers – it is a competitive market and there will be a number of people willing to make recommendations (usually because the solicitors are paying them a fee).
Conveyancing Services – is it necessary to use a solicitor?
There is another type of property lawyer, called a licensed conveyancer. Licensed conveyancers specialise in all types of conveyancing services. In fact they are often better set up to deal with this type of legal work (you may find that normal solicitors, particularly hight street solicitors, only do conveyancing as part of their main practice in other areas of the law). The minus side is that they can only deal with conveyancing so if you get into some kind of dispute, such as a contractual or misrepresentation dispute after completion, you will need to find a solicitor to assist you.
